Elite Equine Marketplace LLC (“Elite Equine”) provides equestrian classified advertising services which includes online resources, classified ads, forums, and industry discount possibilities (collectively, the “Services“) on its Website (https://eliteequinemarketplace.com/) subject to the following Terms of Use (“TOU”). By accessing the Website or using the Services, you expressly (without any limitation or qualification) agreeing to the TOU.
Subsequently, when using a particular Elite Equine Service, you agree to abide by any applicable posted guidelines for that Service, which may change from time to time. Should you object to any term and conditions of the TOU, any guidelines, or any subsequent modifications thereto or become dissatisfied with Elite Equine in any way, your only recourse is to immediately discontinue the use of the Website and its Services. Elite Equine has the right, but is not obligated, to strictly enforce the TOU through self-help, community moderation, active investigation, litigation, and prosecution. Elite Equine does not endorse or ratify any statements made by any user of this Services. Elite Equine may (but shall not be obligated to) report to appropriate governing bodies any act or omission of any person that is in violation for the TOU or the rules, regulations, canons of conduct, or other licensing requirements of such bodies. Elite Equine may (but has no obligation to) remove any content posted on our site at any time for any reason. The Communications Decency Act, 47 U.S.C. 230, provides that Elite Equine, as the provider of service, shall not be treated as the publisher or speaker of any information provided by the users of the site. You warrant that you have the right to use the mode of payment that you provide to us. By providing us your payment card details you allow us to use and store the information. You warrant that any billing information you provide to us is accurate. Providing fraudulent or false information is a breach of these terms and conditions and can result in a cancellation of the provision of Services and other legal actions available under the law. The provision of your credit card or bank account information allows us to debit your account from time to time in the amounts of the fees accrued by you in connection with your use of the Services.
Not all functions of the Service carry a fee. The payments made to the Platform for any purposes, including the listing of advertisements are non-refundable.
Unless otherwise indicated or anything contained to the contrary or any proprietary material owned by a third party and so expressly mentioned, Elite Equine owns all Intellectual Property Rights to and into the Website, including, without limitation, any and all rights, title and interest in and to copyright, related rights, patents, utility models, trademarks, trade names, service marks, designs, know-how, trade secrets and inventions (whether patentable or not), goodwill, source code, meta tags, databases, text, content, graphics, icons, and hyperlinks. In consideration of you agreeing to abide by these TOU, Elite Equine grants you a non- transferable, non-exclusive license to use our Website. Elite Equine reserves all other rights in the Website. You acknowledge that all Intellectual Property Rights of the Website, used anywhere in the world belong to Elite Equine.

We will not be liable for any loss of profits, revenue, contracts, data and savings or damages during the performance our Services that are foreseeable or unforeseeable by us when you start using our Website.
We shall not be held liable for failing to fulfill any obligations under these terms and conditions if the events lie beyond our reasonable control.

This contract is between you and Elite Equine. No other person shall have any rights to enforce any of its terms. Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
If Elite Equine fails to insist that you perform any of your obligations under these TOU, or if it does not enforce its rights against you, or if it delays in doing so, that will not imply that it has waived its rights against you and will not mean that you do not have to comply with those obligations.
If Elite Equine does waive a default by you, it will only do so in writing, and that will not mean that it will automatically waive any later default by you.
Any disputes arising between you and Elite Equine is to be governed by and construed in accordance with the laws of United States.
